Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Johnny Drinks Inc. (“we”, “us”), the operator of Ladle at ladlerecipe.com (the “Service”). By creating an account, buying a membership, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to create an account. Some recipes contain alcohol; they are intended only for people of legal drinking age where they live (21 in the United States). Please drink responsibly.
2. Your account
You are responsible for keeping your login details secure and for everything done under your account. Accounts are personal: do not share them or resell access. Tell us promptly at hello@ladlerecipe.com if you think your account has been used without your permission.
3. Memberships and payment
Full recipes are available to members. We offer two ways in. Lifetime access is a single payment for access to member features for as long as we operate the Service. A monthly membership is a recurring charge, billed in advance each month until you cancel; your access continues to the end of the period you have paid for.
Prices are shown before you pay. Payments are processed by Stripe, and by paying you authorize us, through Stripe, to charge your payment method for that one-time purchase or, for a monthly membership, for each monthly renewal until you cancel. You can cancel a monthly membership at any time from the billing portal on your account page. We may change the price for future buyers or future renewals; a price change does not affect access you have already paid for, and we will tell you before a renewal price changes.
4. No refunds
All sales are final. We do not offer refunds for any purchase, including lifetime access and any monthly payment already made. Cancelling a monthly membership stops future charges; it does not refund the current month. Nothing in this section limits any right to a refund that applicable law gives you and that cannot be waived.
If a payment is refunded for any reason, including where required by law, or is reversed through a chargeback, the access that payment bought ends immediately. We may suspend an account while a payment dispute is open.
5. Content and your licence to use it
Recipes, photos, videos and other material on the Service belong to us or to the creators who publish them. While your account is in good standing, we give you a personal, non-exclusive, non-transferable licence to view that material and use it to cook at home. You may not copy, republish, sell, or redistribute it, or scrape, bulk-download, or otherwise collect it by automated means.
Recipe details, including ingredient amounts, steps and timings, are prepared in part with automated tools and may contain mistakes. Check ingredients for allergens, follow safe food-handling practices, and use your own judgment in the kitchen.
6. Creators
If you publish recipes on the Service as a creator, you also agree that:
- You own, or have permission to use, everything you import or upload, and publishing it does not infringe anyone else’s rights.
- You grant us a worldwide, royalty-free licence to host, copy, process, adapt (for example, by extracting a written recipe and still images from a video), display and distribute that content to operate and promote the Service. The licence ends when you delete the content, except for copies retained in backups for a limited time.
- You authorize us to retrieve posts from social accounts you connect, and to process your videos, captions and audio with automated and AI tools to produce recipes. You are responsible for reviewing a recipe before you publish it.
7. Acceptable use
Do not break the law using the Service, interfere with or try to gain unauthorized access to it, reverse engineer it, get around its paywall or security, or use it to harass anyone or send spam. We may remove content or suspend or close accounts that break these Terms.
8. Third-party services
The Service relies on and links to services we do not control, including Instagram and Stripe. Their own terms and policies govern your use of them, and we are not responsible for them.
9. Ending your account
You can stop using the Service at any time, and can ask us to delete your account by emailing us. We may suspend or end your access if you break these Terms or if we stop operating the Service. Sections 4, 5, and 10 through 13 survive the end of your account.
10. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that the Service will be uninterrupted or error-free, or that any recipe will turn out as described.
11. Limitation of liability
To the fullest extent the law allows, Johnny Drinks Inc. will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.
12. Indemnity
You agree to defend and indemnify Johnny Drinks Inc. against claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or from content you publish on the Service.
13. Governing law
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in New Jersey, and you and we consent to their jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. If a change is material we will let you know, for example by email or on the Service, before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
